State Traffic Safety Resource Prosecutor (TSRP) offering Five-Part Webinar Training: Warning to Motorist/Statutory Summary Suspension class 

Cook County State's Attorney's Office and the Illinois Traffic Safety Resource Prosecutor program will be breaking State TSRP Jen Cifaldi's 6-hour in person Warning to Motorist/Statutory Summary Suspension class into a 5 part webinar series.  That series will begin on January 4, 2021 at 3:30pm.  When that series is complete, they will be offering virtual trainings monthly on various traffic safety related topics.  These webinars will be available to both prosecutors and law enforcement officers and Continuing Legal Education credits will be available for prosecutors.

Description: This 90-minute course will provide law enforcement and prosecutors with the knowledge and skills to successfully use the proper Warnings to Motorists and remove impaired drivers from our Illinois’ roadways.

 

The attendees will receive training on the Standard DUI Warning to Motorist form used to obtain chemical test compliance. They will also receive instruction on DUI case law specific to Implied Consent and tips on courtroom testimony.

 

This training will assist officers in correctly filling out all the Warning to Motorist forms and assist prosecutors in aiding the officer when mistakes are made.

Jan 19, 2021 03:00 PM: Part 2--The DUI Cannabis Warning to Motorists and Tips to Identify Drivers Impaired by Cannabis

 

Description: This two hour program was developed with the intent of providing law enforcement with the knowledge and skills to successfully navigate their way through a DUI Cannabis arrest and specifically for using the new Cannabis Warning to Motorist.

 

This class will instruct the attendees on how to correctly identify a cannabis impaired driver and utilize the new Cannabis Warning to Motorist. The officer will be able to recognize how cognitive behaviors are affected by this drug and how those behaviors are evident during a DUI investigation.

 

The attendees will have a better understanding of what is needed to determine reasonable suspicion to use the Warning and what elements are needed to establish probable cause for the arrest. Additionally, attendees will be familiar with how cognitive impairment is revealed through indicators and clues observed on the Standardized Field Sobriety Tests, specifically related to cannabis. There will also be discussion on the Advanced Roadside Impaired Driving Enforcement (ARIDE) training and Drug Recognition Expert (DRE) training.

 

Furthermore, there will be discussion on Constitutional Law and Search and Seizure topics as they relate to cannabis and probable cause to search the vehicle.

Feb 1, 2021 03:00 PM: Part 3--The Type A/Fatal Warning to Motorists and Understanding the Use of Hospital Blood Draws

 

Description: This two hour program was developed with the intent of aiding attendees in the use of the Type A/Fatal Warning to Motorists and understanding under what circumstances it may be used. Attendees will know when to use this Warning versus the Standard DUI Warning, what a Type A injury is and common legal challenges to this Warning. Additionally, there will be instruction on the use of 625ILCS5/11-501.4-1 regarding obtaining hospital blood results and the benefit of securing the hospitals' sample for further testing.

Feb 15, 2021 03:00 PM: Part 4--The Zero Tolerance Warning and Commercial Motor Vehicle Warning to Motorists

 

Description: This 90-minute course was created by Illinois Traffic Safety Resource Prosecutor, Jennifer Cifaldi. The purpose of this program is to provide instruction to officers and prosecutors on the use of the Zero Tolerance Warning as well as the Commercial Motor Vehicle Warning. The attendee will understand what criminal offenses are available to the officer in various situations. Additionally, the attendee will have a better understanding of the Commercial Driver's License law as it relates to Impaired Driving offenses. This presentation will also include discussion on the relevant case law and possible defense challenges.

Description: This 90-minute program was created to explain the purpose of statutory summary suspension hearings and petitions to rescind. The attendee will have a better understanding of the statutory challenges in such a hearing as well as the relevant case law. This presentation will aid the attendee in preparing for testimony at the hearing and overcoming common defense challenges.

 

This will be a live presentation and will include a question and answer session at the conclusion of the program.

FREE On-line Traffic Incident Management Training

The National Traffic Incident Management Responder Training is a FREE on-line training course for all first responders. The training is 4 hours long and covers many of the Traffic Incident Management (TIM) procedures, including:

  • TIM fundamentals and terminology;

  • Safe vehicle positioning, traffic management, and scene safety;

  • Command responsibilities;

  • Clearance and termination.

Accident scenes cause congestion and can bring a secondary crash, which endangers the lives of first responders. Recent incidents in Pennsylvania and South Carolina show how deadly highway response is. The longer responders are on the scene, the greater the risk they face. Faster and better response helps limit secondary accident risks.

The Emergency Responder Safety Institute also provides assistance for first responders to help them be better prepared for accident scenes and highway operations. Resources include information on high visibility PPE and vehicle markings, sample SOPs/SOGs, training, data on “struck by” incidents and line of duty deaths, and education materials.
